Federal Overtime Rules
Under FLSA:
- Overtime rate: 1.5× regular hourly rate
- Threshold: Hours exceeding 40 per workweek
- Applies to: Non-exempt employees
Calculation Formula
OT Pay = Regular Hourly Rate × 1.5 × Overtime Hours
Total Pay = (Regular Hours × Regular Rate) + (OT Hours × OT Rate)
Examples
Example 1: Simple Overtime
- Regular rate: $20/hour
- Hours worked: 48 hours
- Regular pay: 40 × $20 = $800
- OT pay: 8 × $30 = $240
- Total: $1,040
Example 2: Multiple Rates
If you work at different rates:
- Rate 1: 30 hours × $18 = $540
- Rate 2: 15 hours × $22 = $330
- Total hours: 45 (5 hours OT)
- Weighted average: $870 ÷ 45 = $19.33
- OT rate: $19.33 × 1.5 = $29.00
- OT pay: 5 × $29.00 = $145
- Total: $870 + $145 = $1,015
State-Specific Overtime
California (Daily Overtime)
- Over 8 hours/day: 1.5× rate
- Over 12 hours/day: 2× rate
- 7th consecutive day: First 8 hrs at 1.5×, remaining at 2×
Other States with Daily OT
- Alaska: Over 8 hours/day
- Colorado: Over 12 hours/day
- Nevada: Over 8 hours/day (if rate < 1.5× minimum wage)
