Federal Overtime Rules

Under FLSA:

  • Overtime rate: 1.5× regular hourly rate
  • Threshold: Hours exceeding 40 per workweek
  • Applies to: Non-exempt employees

Calculation Formula

OT Pay = Regular Hourly Rate × 1.5 × Overtime Hours

Total Pay = (Regular Hours × Regular Rate) + (OT Hours × OT Rate)

Examples

Example 1: Simple Overtime

  • Regular rate: $20/hour
  • Hours worked: 48 hours
  • Regular pay: 40 × $20 = $800
  • OT pay: 8 × $30 = $240
  • Total: $1,040

Example 2: Multiple Rates

If you work at different rates:

  • Rate 1: 30 hours × $18 = $540
  • Rate 2: 15 hours × $22 = $330
  • Total hours: 45 (5 hours OT)
  • Weighted average: $870 ÷ 45 = $19.33
  • OT rate: $19.33 × 1.5 = $29.00
  • OT pay: 5 × $29.00 = $145
  • Total: $870 + $145 = $1,015

State-Specific Overtime

California (Daily Overtime)

  • Over 8 hours/day: 1.5× rate
  • Over 12 hours/day: 2× rate
  • 7th consecutive day: First 8 hrs at 1.5×, remaining at 2×

Other States with Daily OT

  • Alaska: Over 8 hours/day
  • Colorado: Over 12 hours/day
  • Nevada: Over 8 hours/day (if rate < 1.5× minimum wage)
