California Pay Stub Requirements

California Labor Code Section 226 requires employers to provide detailed, itemized wage statements to all employees.

Mandatory Information

California pay stubs must include:

  1. Gross wages earned during the pay period
  2. Total hours worked (for non-exempt employees)
  3. Number of piece-rate units and rate (if applicable)
  4. All deductions itemized
  5. Net wages earned
  6. Pay period start and end dates
  7. Employee name and last four digits of SSN (or employee ID)
  8. Employer's legal name and address
  9. All applicable hourly rates and corresponding hours worked at each rate
  10. Paid sick leave balance available

Additional Requirements

  • Pay stubs must be provided each pay period
  • Must be in a format the employee can understand
  • Electronic pay stubs are allowed if employees can print them
  • Must be provided even if payment is by direct deposit

Penalties for Non-Compliance

  • Initial violation: Up to $50 per employee per pay period
  • Subsequent violations: Up to $100 per employee per pay period
  • Maximum penalty: $4,000 per employee
  • Additional: Employee can recover actual damages and attorney fees

  • Daily overtime — Pay stubs must reflect daily OT (over 8 hours/day)
